"How can Ajit Pawar have the support of these people, how can he, who has been removed as legislative party leader, become the deputy chief minister [of Maharashtra]", Singhvi argued.
In a stunning political development, Governor Koshyari on Saturday morning had administered the oath of office to Fadnavis as the new Chief Minister of Maharashtra and NCP leader Ajit Pawar as his deputy.
Accusing Ajit Pawar of taking false documents to Raj Bhawan to prove that the NCP MLAs are in support of a BJP-led government, Raut said that Governor Bhagat Singh Koshyari should not have accepted those documents.
After a prolonged uncertainty over the government formation that lasted for almost a month, Devendra Fadnavis on Saturday early morning took oath for the second consecutive term as the state Chief Minister, while Ajit Pawar as his deputy chief minister.
Even as all the MLAs believed to be at his side, are said to have returned to Sharad Pawar, the use of the term "our" by Ajit Pawar raises many questions.
The Supreme Court was hearing a plea filed by the Shiv Sena-Congress-NCP on Saturday night, challenging the decision of the Maharashtra Governor to invite the BJP to form the government.
Following the meeting, BJP leader Ashish Shelar stated that leaders outlined a plan to pass the majority test in the 288 member Assembly.
Singhvi said the governor should have waited for a floor test in the Maharashtra Assembly before going ahead with the swearing-in of Fadnavis and Pawar.
Later on Saturday, the Shiv Sena, the NCP and the Congress moved the Supreme Court with an urgent petition against Koshyari's decision to invite the BJP to form the government.
"In this meeting, we discussed and decided the strategy to comfortably pass our floor test. For Maharashtra's benefit Fadnavis and Ajit Pawar joined hands and took the oath", he said. "How is it possible for someone claiming majority yesterday to shy away from a floor test today?"
The party had said that Ajit Pawar can not issue a whip to the legislators during the floort test.
Rohatgi said how can a political party approach the apex court under Article 32 for violation of Fundamental Rights.
The Supreme Court on Sunday asked solicitor-general Tushar Mehta to place before it on Monday morning the letters of the state governor recommending revocation of President's rule and inviting Devendra Fadnavis to form the government in Maharashtra. Raut claimed that at least 49 out of 54 NCP MLAs are with the alliance.
The BJP had won 105 seats in the Maharashtra Assembly elections, results of which were announced on October 24.
