The 12-person jury is made up of four white women, six white men, one black woman and one black man. They have been working for more than 40 hours since getting the case on Monday.
Cosby did not testify, but his account was shown to the juror in the form of a police interview from 2005, as well as sworn depositions he gave in 2005 and 2006 as part of Constand's civil lawsuit against him. His lawyer has said they were lovers sharing a consensual sexual encounter. She said after she started experiencing those effects, Cosby escorted her to a sitting room, he testified.
"You've sent word: You're exhausted", said Judge Steven O'Neill, dismissing the panel until Wednesday morning.
"The judge has announced that the jury is deadlocked". "And they're hearing Mr. C.'s testimony and he's extremely truthful". And thats created this doubt..
But so far, the jury said it hasn't unanimously decided whether he's guilty. The district attorney's office declined to comment.
Constand is not the only woman who says Cosby raped or sexually assaulted her. Dozens of women have come forward over the past several years, with stories that echo one another.
An elated Cosby smiled broadly as O'Neill read the note.
Reporters rushed outside to file the news and I think it's the first time I've had an elderly lady try and shoulder barge me as she rushed to be first to tweet.
The judge in the sexual assault case of comedian Bill Cosby has declared a mistrial.
The prosecution spent a week presenting its case, and the defense less than a day.
The case has already helped demolish his nice-guy reputation as America's Dad.
He did not take the stand in his sexual assault trial.
The jury has gone back and forth between various accounts of the incident from both Cosby and Constand, asking that trial testimony and key documents be reread to them. "If they don't have a verdict by now, we'd hope the judge would relieve them". At 9 p.m., they left the courtroom for the night.
A hung jury would represent a clear victory for Cosby, who would avoid what could have been years in prison for three counts of aggravated indecent assault.
Cosby faces up to 10 years in prison on each of the three counts, but they could be merged for sentencing purposes. A Pennsylvania jury was set to deliberate a fourth day Thursday, still deadlocked on whether to convict disgraced megastar Bill Cosby of committing sexual assault more than 13 years ago.
"They're conflicted about the inconsistencies in Ms. Constand'stestimony", spokesman Andrew Wyatt said.
