A police officer seen in a video "doing nothing", while a woman was being harassed by a drunk man for wearing a Puerto Rico flag shirt, has resigned.
Timothy Trybus, 62, was previously charged with disorderly conduct and assault. "We are further addressing aspects of this incident", a spokesperson for the Forest Preserves of Cook County said in a statement, adding the superintendent would address the matter to the media on Thursday.
The viral video clip shows Mia Irizarry, 24, setting up her picnic when a white man approaches and demands to know why she is wearing her shirt, which had "Puerto Rico" written on it. She repeatedly asked a nearby park police officer for his assistance, saying she was being harassed and felt uncomfortable.
But the video makes clear that we all have to step up to defend the United States from this tide of bullying, misogyny, homophobia, and xenophobia, and stand up for what America is really all about. Irizarry is heard telling Trybus that Puerto Rico is part of the United States as he approaches her multiple times. A 62 year old man who police have identified as Timothy Tybus verbally abused and harassed Ms. Irizarry as she was wearing a shirt that depicts the flag of our USA colony of Puerto Rico.
At one point in the video, Irizarry tries to move away from Trybus and walks out from under a pavilion, but he follows her as Connor appears not to approach them.
The officer resigned Wednesday and the investigation into the incident continues, the agency said.
The woman, who apparently is the one recording the encounter, can be heard talking but her face is not shown.
"Is there anything you can do?" she said. She asks a park police officer to help, saying: "I am renting this area, and he's harassing me about the shirt that I'm wearing". "You should be wearing United States of America flag", he said.
Cook County Commissioner Jesús "Chuy" García had called for such charges against Trybus a day earlier. "At the same time, this video will help inform ongoing officer training so we can all learn from this unfortunate episode".
Mr Trybus continued to harangue Ms Irizarry for about 10 minutes before other officers arrived and arrested him.
Puerto Rico is a USA commonwealth with its own constitution rather than a state.
"You are not going to change us, you know that, right?"
Eventually the first officer on the scene takes notes of Irizarry's account of the incident and says that he was at the scene due to the separate incident, noting that she was not being attacked though acknowledging she felt threatened. President Woodrow Wilson in 1917 signed into law the Jones-Shafroth Act, granting USA citizenship to residents of Puerto Rico.
